October 21, 2019- Commonwealth v. Calvin McKinney: On October 21, 2019 Judge William Tully sentenced Calvin L. McKinney to ten to twenty years in state prison after a jury convicted him of attempted murder in August. It was alleged that on December 29, 2017 McKinney attempted but failed to kill Keynan Guider near 20th and Market Streets in the City Of Harrisburg. During that incident, numerous shell casings were located and an eyewitness identified him as the shooter at trial in mid-August of this year.
It was also alleged that on December 31, 2017, McKinney shot and killed Guider in the 1900 block of Brookwood Street in Harrisburg. Both of those cases went to trial in August and McKinney was found guilty of the first incident. The jury was hung on the murder charge resulting in a mistrial. The re-trial of the murder is scheduled for December. In early October, the prosecutor assigned to the case, Chief Deputy District Attorney Stephen R. Zawisky, approved a perjury charge against McKinney. Zawisky is alleging that McKinney lied during his testimony at the first trial.
The felony perjury complaint alleges that during the original murder trial McKinney testified that he left the night of the murder and traveled to King of Prussia because of a pre-planned get-away. At trial, he testified that he made the travel arrangements a few weeks earlier and pointed to a bank transaction where he paid Priceline.com for a hotel stay. McKinney claimed that the early December transaction was for a hotel room near King of Prussia the night of the murder and that he planned on going there for weeks. This testimony countered the Commonwealth’s argument that McKinney fled to King of Prussia in the middle of the night directly after the murder. At trial, the Commonwealth presented historical cell tower records which had McKinney leaving the Harrisburg area at 2-3 a.m. and heading towards King of Prussia. The murder took place at approximately 1:30 a.m. The Commonwealth is alleging in the perjury complaint that the Priceline.com transaction was actually for an early December hotel stay in Grantville, PA and was not for the December 30-31, 2017 stay near King of Prussia like McKinney claimed on the witness stand.
NOTE: While McKinney was convicted of the attempted murder of Kenynan Guider, he is presumed innocent of the actual murder of Mr. Guider and the perjury allegations unless or until he is convicted in court on those charges.
