October 1, 2015- Commonwealth v. Cory Drayton: Following a preliminary hearing before Magisterial District Judge Barbara Pianka, a charge of felony aggravated assault was bound over to the Dauphin County Court of Common Pleas against Cory Drayton. Testimony during the hearing revealed that an altercation arose between the victim and Drayton, and Drayton shot two times at the victim hitting him once in the leg. While testifying, the victim, who lived in the same house as Drayton, claimed that the altercation arose over the victim smoking a cigarette in the house. Despite giving a statement to police the night of the incident, as well as one immediately prior to the hearing, the victim stated for the first time during testimony at the hearing that he had a knife in his possession prior to the shooting. Police did not find the knife at the scene. Senior Deputy District Attorney Jack Canavan found it “certainly interesting” that the victim neglected to mention this fact prior to testifying. After the conclusion of the testimony, MDJ Pianka bound the aggravated assault charge over to the Court of Common Pleas and set an arraignment date of December 17, 2015.
