Commonwealth v John M. Poyer: On Friday, April 3, 2015, following a preliminary hearing, Magistrate Joseph Lindsey held all charges filed against John M. Poyer for Dauphin County Court. Following a fatal two-vehicle accident, Poyer was arrested and charged with Homicide by Vehicle while Driving Under the Influence, three counts of Aggravated Assault by Vehicle while Driving Under the Influence, Driving Under the Influence, and multiple traffic offenses. These charges arise out of a vehicle collision that occurred on November 1, 2014, around 9:30 p.m. on Nyes Road, just south of Locust Lane, in Lower Paxton Township. According to the accident reconstruction developed by Lower Paxton Police Officer Brian McIntyre and members of the Dauphin County Accident Reconstruction Team, Poyer’s vehicle, was traveling southbound on Nyes Road when he suddenly veered into the northbound lane of travel and collided with the victim's vehicle. That vehicle was occupied by a driver, front seat passenger, and a right rear seat passenger. As a result of the accident, 76-year-old Van Bich Thi Nguyen, the right rear seat passenger, was killed. Additionally, the driver and passenger suffered severe injuries, including multiple broken bones. When officers and emergency personnel arrived on scene, they observed Poyer to have a strong odor of alcohol, glassy eyes, and slurred speech. Poyer admitted to officers that he drank “way too much” that evening; specifically, he indicated he drank multiple mixed drinks. Ultimately, Poyer was found to be operating his vehicle with a blood alcohol content of .185%. Poyer is next scheduled to appear for his formal arraignment on May 5, 2015, before the Dauphin County John F. Cherry. This case is being prosecuted by Deputy District Attorney Andrew Jarbola IV.
Note: The charges against Mr. Poyer are only an allegation at this point and he is presumed innocent unless, and until, he is found guilty in court.
