On October 27, 2019 at approximately 7:30 p.m., Harrisburg Police were dispatched to 2153 Penn Street for a report of a male shot. When police arrived, the shooting victim had already been removed and was transported by a friend to the Harrisburg Hospital where he died from his injuries. After an investigation by the Harrisburg Bureau of Police and the Dauphin County District Attorney’s Office, the following was determined:
Raymond Bosque, 19 of Lancaster, travelled to Harrisburg to meet up with Jordan Gregory, age 18, and Baith House, age 24, in order to purchase two pounds of marijuana from them. Gregory had known Bosque from high school in Lancaster. When Bosque arrived at the home, he was asked to enter in order to complete the transaction. All three then entered the basement to complete the transaction. Once in the basement, House and Gregory attempted to rob Bosque of the money he brought with House punching Bosque in the head.
After Bosque was taken by surprise, both Gregory and House started assaulting Bosque. Bosque then fired several shots at House in attempt to fend off his attackers. House, who was struck five times in the upper body as well as arms, fled upstairs and collapsed on the living room floor while Bosque and Gregory engaged in a fight. Gregory eventually obtained control of Bosque’s firearm and attempted to discharge it in the direction of Bosque but could not since it was empty. Bosque then fled the basement and Gregory discarded the now empty handgun in a box in the basement. Bosque then fled the residence and drove back to Lancaster. Gregory then contacted a friend and drove House to the hospital where he was pronounced dead.
Pursuant to statute, deadly force is justifiable if the actor believes that such force is necessary to protect himself against death or serious bodily injury. In the present case, Bosque who is approximately 5’10’’ and 120 pounds, was the victim of a surprise attack and was robbed by two individuals in their dimly lit and dirty basement. The Commonwealth believes that both Gregory and House planned the robbery and targeted Bosque because of his small stature and his lack of street smarts. The Commonwealth concluded that Bosque reasonably believed that deadly force was necessary under the circumstances that existed.
The Commonwealth has charged Jordan Gregory with robbery, criminal conspiracy criminal attempt murder, aggravated assault and related offenses in connection with this incident. Bosque is charged with carrying a firearm without a license since he carried the handgun concealed without having a permit. Under Pennsylvania law, in order to obtain a license to carry concealed, a person must be at least twenty-one years of age. These are mere allegations and the defendants are presumed innocent.
The case was investigated by HPD detectives Richard Iachini, Jason Brinker and Chris Silvio as well as Chief Deputy District Attorney Stephen R. Zawisky.
