October 12, 2015- Commonwealth v David Pfautz: On October 12, 2015, David Pfautz pled guilty to one count of Theft by Failure to Make Required Disposition. A police investigation determined that Pfautz misappropriated $56,276.99 of funds from his deceased brother's estate. As part of his guilty plea, Pfautz made a restitution payment of $56, 276.99.
In January 2013, Defendant’s brother died unexpectedly. The day after the death, Pfautz had the widow of his brother sign a power of attorney for the estate, which included her children’s trust funds. After receiving the power of attorney, Pfautz used the funds from the estate to his own benefit, purchasing items for himself including stereo equipment for his vehicle and boat. Pfautz also used the money to pay off debts that he accumulated. This continued until the power of attorney was revoked after family members became suspicious that there was a misuse of funds. After the revocation of the power of attorney, it was determined that Pfautz misused $56,276.99 of the estate for his own personal gain.
At sentencing, Pfautz’s niece provided a written impact statement that was read to the court detailing the significant emotional impact this has had on her family and that the betrayal by her uncle has been absolutely devastating to her family. The widow of Pfautz’s brother also provided an impact statement that echoed her daughter and detailed the emotional impact that this caused her family, especially considering Pfautz’s constant postings on social media regarding his lavish lifestyle, but also how it has made her and her children realize the importance of family and has made them stronger.
Detective Ryan Gartland of the Lower Swatara Police Department investigated this case. Deputy District Attorney Codi Tucker prosecuted the case on behalf of the Commonwealth.
