The Supreme Court of the United States again denied a petition for writ of certiorari filed by convicted child murderer, Herbert Blakeney. In 2002, a jury convicted Blakeney of killing 14 month old Basil Shabazz by slashing his throat. The Supreme Court of Pennsylvania affirmed the conviction in 2008 and the Supreme Court of the United States denied a petition for a writ of certiorari in 2009. That same year, Governor Edward G. Rendell signed an execution warrant for Blakeney. After Blakeney filed a petition for post conviction relief, the trial court issued a stay of the execution. Judge John F. Cherry denied post conviction relief and the defendant appealed. The Pennsylvania Supreme Court affirmed that judgment on December 29, 2014. Blakeney then filed the recently denied petition to the Supreme Court of the United States. District Attorney Edward M. Marsico, who prosecuted Blakeney, expressed hope that this step might bring justice for Basil Shabazz closer.
