On February 14, 2022, Judge Scott Arthur Evans sentenced Xavier Cruz on two counts of homicide by vehicle to 6 to 23 months in the Dauphin County Prison and 60 months of probation. On Friday, October 2, 2020, at approximately 6:13 p.m., Shaun Yuhas, age 42, and Linda Silva, age 50, were traveling southbound on I-81 near mile marker 67 when Xavier Cruz, age 18, driving a Toyota Corolla, cut into their lane and forced them off the highway. The vehicle occupied by Yuhas and Silva sheared off one light pole, then slammed into a second pole, wrapping around it. The crash killed both Yuhas and Silva. Eyewitnesses saw Cruz weaving in and out of traffic just before the crash. At the time he made the reckless lane change and struck the other vehicle, Cruz's speed was 109 miles per hour. Cruz’s vehicle veered off the roadway after contact and traveled a significant distance past the victims’ vehicle before crashing. Although Cruz’s vehicle sustained extensive damage, he was not injured.
First Assistant District Attorney Mike Sprow, who prosecuted the case, commented: “The level of recklessness exhibited by Xavier Cruz on that evening was outrageous. As is typical for a Friday at 6:00 p.m., there were many other cars traveling on that stretch of road at the time of the crash. It is miraculous that nobody else was injured or killed. We are hopeful that this serves as a wake up call for Mr. Cruz and that he learns from this tragic lapse of judgment.”
Troopers Katelin Kurtz and Glen Knudsen of the Pennsylvania State Police conducted the investigation that led to the charges and conviction. In addition to incarceration and probation, Xavier Cruz will have to pay court costs, $2,858.00 in fines, and at least $8,000.00 in restitution. He will also lose his driver's license for numerous years.
