Persons desiring to engage in any transient retail business, soliciting, or peddling in the Township of Derry shall first file an application with the Derry Township Police Department. All applicants are subject to a background check and the Chief of Police will approve or deny the permit based on the results of the background check. Applications will be accepted Monday-Friday from 8:00 am - 3:30 pm (except Holidays). Approved permits can be picked up at the station, or mailed to the applicant. Fees can be paid with cash (exact amount) or with a check/money order made out to Derry Township.
There are three different applications processes:
1. Door-to-door soliciting/peddling: These permits are required by each person soliciting business without a fixed location, including but not limited to door to door salespersons and street vendors. Applications, along with a valid photo id and payment, must be received in person (emailed, mailed, or faxed applications will NOT be accepted). All issued permits expire on the last day of the month issued and there will be no proration for applications filed in the middle of a month. 2. Food Truck/Fixed Site Vendor: These permits are required for persons conducting transient retail business activities from a fixed location. Applications, along with a valid photo id, must be received in person or via mail (emailed or faxed applications will NOT be accepted). The permit granted shall be valid for the calendar year for which it has been approved and there will be no proration for applications submitted for less than a full calendar year. NOTICE – Any reports of discourteous, rude sales practices or soliciting in violation of the rules set forth to obtain this permit will be grounds for revocation of this permit. This shall include soliciting at residents, businesses, or areas where signage or verbal notice has been given against soliciting.
Yes, certain people, non-profits, and businesses are exempt from having to apply for a soliciting permit. The complete list can be found in the ordinance. In general, farmers or dairy, bakery, or meat producers selling their own products; those collecting money for non-profits; insurance agents/brokers; the delivery/collection of dry cleaning are exempt. However, please check the ordinance or call the Police Department before assuming you do not need a permit.
